Do I need a lawyer for mediation?
Homeowners and any other parties may have legal representation at mediation (at their own expense) but do not have to. Territorial authorities (city and district councils) are likely to have legal representation. Parties can ask the Weathertight Services settlement advisor (for lower-value claims) or Ministry of Justice Case Manager (for standard claims) who is legally represented.
Is legal aid available for homeowners going to mediation?
Legal aid is not available for mediation.
Who is responsible for locating parties to WHRS claims?
At the request of claimants and in order to speed up the resolution process and to promote cost-effectiveness, Weathertight Services makes reasonable efforts to locate parties. (Homeowners are asked to provide as many details as possible of any parties, including their name, role in respect of the property, address and contact phone number.) Homeowners are able to take additional steps themselves if they wish.
Where are mediations held?
Mediations are held at venues as close as possible to the address of the affected dwellinghouse.
Will people outside the main centres have to wait longer for mediation?
No. If a local mediator is not available, then someone will travel to smaller centres as required.
