Building Amendment Act 2008

The Building Amendment Act 2008 came into force on 15 March 2008. It contains some minor adjustments to improve the workability of the Building Act 2004, and to improve the clarity and effectiveness of the regulatory framework. This will encourage an efficient and fair provision of building and local government services for New Zealanders.

The Building Amendment Bill was introduced in Parliament on 18 July 2007 and received its third and final reading on 13 March 2008.

An electronic copy of the Act is availableNew Zealand Legislation website. and a consolidated version of the Building Act 2004New Zealand Legislation website. (with the 2008 amendments) is available, and printed copies are available from Bennett’s Government Bookshop. A Navigation guide to the Building Amendment Act 2008 is available.

Note: The Building Amendment Act does not contain the proposals announced by Minister Shane Jones in March 2008 to streamline aspects of the building consent process with, for example, ‘multiple use’ consents for large volume builders, (further) building consent exemptions, and a more flexible consents process for starter homes. The Department of Building and Housing will report to the Government by 30 May 2008 on how best to implement these proposals. Details of these proposals are in a news release dated 25 March 2008Beehive website.
